Case No. 306 Wm. M. Joiner v. A.G.G. Perkins in the Lee County Superior court went on to the Texas District Court and the Texas Supreme Court. This was a long and protracted lawsuit that ended in 1883. Algerine didn't pay for property he bought, and this is the lawsuit regarding enforcing a judgment for payment. It is 118 pages of which I have a copy.

Case 306: Wm. M. Joiner Adm. vs. AGG Perkins. Nov 5/83 Leave given plaintiff to file his amended original petition to Nov. 6. Leave given the Officer Executing the writ of attachment herein [ ] to amend his return on said writ of attachment.
Case 306 Wm Joiner Adm vs. AGG Perkins. Nov 13th. This day came the parties by their attorneys and [ ] same cause on to be heard the defendants motion to quash the attachment herein, and the same being assigned by [ ] before the Court, it is ordered that the motion be sustained to which ruling of the court the defendants excepts. [This is crossed out: "then came on to be recorded the Defts motion for a continuance and being submitted to the court it is ordered that it be overruled and then comes on to be heard the demurrer to plaintiffs petition and the same being submitted to the court, it is ordered that" then continuing but not crossed out:] The motion of Defts to Strike out plaintiffs amended original petition is called up for a hearing, it is ordered that the motion be overruled. To which ruling of the Court the defendant excepted. The motion of defendant to plaintiffs petition being submitted to the Court is overruled - Defendant except. Then came one the motion of defendants for a continuance which was by the court overruled. To which ruling defendants excepted. The cause then came on for trial.

William M. Joiner Adm. Estate of William Joined dec'd v. A.G.G. Perkins. SS No. 306 15th day of May A.D. 1884 This day came the parties, by their attorneys, and waive a jury and submit the matter in controversy, as well of fact as of law, to the court; and the evidence and the argument of counsel having been heard and fully understood; and it appearing to the court, from the evidence aforesaid, that the defendant is indebted to the plaintiff in the sum of two hundred and eight Seven and 90/100 dollars, and that one of the notes sued on bears interest at the rate of ten percent per annum, and the other note sued on bears legal interest and it further appearing to the Court that said notes were executed on the 8th day of December A.D. 1878 to Secure the payment of the pruchase money for the following described tract of land, to wit: Situated formerly in the western portion of Burleson County (Texas) but now situated in said Lee County in the State of Texas, on the waters of the third [Yegna], being a part of the P. Wimberly Survey, and bounded and described as follows - Beginning at the N.W. Corner of a Survey in the name of Reaves; thence N 79 W 235 varas to a stake from which a Black Jack marked V bears S 19 degrees E 2 varas; thence N 71 degrees E 640 varas to a rock from which a Port-oak marked P bears S 29 degrees W 7 varas; thence S 70 E 280 varas to a point in the middle of Woolley Branch; thence down said Branch in a Southern direction to a point where the South boundary line of the Wimberly Survey crosses said Branch; thence S 71 degrees W with said South boundary line 170 varas to a S.E. corner of the Reaves Survey Then N 19 W 92 varas to an Elm and corner of Said Survey; thence N 71 E 140 varas to a S.E. corner of said Reaves Survey; thence N 19 degrees W 100 varas to the N.E. corner of Said Survey; thence S 71 degrees W with the north boundary line of Said survey 825 varas to the beginning corner, containing thirty-four (34) acres of land, it is therefore considered by the court that the plaintiff William M. Joiner as administrator of the estate of William Joiner deceased, do have and recover of the said defendant A.G.G. Perkins said sum of two hundred and eighty-seven and 00/100 collars principal and interest which interest on two hundred and twenty-five and 45/100 dollars thereof from this date at the rate of ten (10) percent per annum, and with legal interest on Sixty-two and 25/100 dollars thereof from this date, together with his costs in this behalf expended, and it is ordered adjudged and decreed by the Court that the [vendan] lien as it existed upon the 8 day of December A.D. 1787 upon the above described tract of land, be and the same is hereby foreclosed and that the Clerk of this Court do issue an order of Sale directed to the Sheriff or any constable of Lee County commanding him, the said officer, to seize and sell the above described tract of land, as under execution, that he apply the proceeds thereof to the payment and satisfaction of the said sum of two hundred and eight-seven and 90/100 dollars; together with all interest - may be due thereon and the cost of this suit. If the said land shall sell for more, than sufficient to pay off and satisfy said sum of money then the said officer is hereby directed to pay over the excess to the defendants; but if the said land shall not sell for enough to pay off and satisfy this judgment then the Clerk of this Court is directed to issue execution for the balance remaining unpaid.

Know all men by these presents; that I Mary [T. or F.] Jenkins (was Mary [T. or F.] Bailey) joined by her husband Thomas Jenkins of Eugene County and State of Oregon in consideration of the sum of Fifty dollars to us in hand paid by A.G.G. Perkins and the further consideration of the certain two promissory notes payable to Mary [T. or F.] Jenkins or bearer, each of the sum of Fifty [S?] dollars and fifty cents, each bearing [ ] date herewith and each having interest from date at the rate of ten percent interest per annum; the first payable on or before twelve months after date and the second note payable twenty four months after date, each of said notes executed and signed by A.G.G. Perkins, and to secure the payment of each of said notes, the vendors lien is expressly [ ] and retained on the hereafter described and conveyed land, have granted, sold and conveyed and by these presents do grant, sell and convey unto the said A.G.G. Perkins of the County of Colorado and State of Texas, the following described piece parcel or tract of land, lying and being situated in the county of Colorado State of Texas on the waters of Skill Creek and described and [surveyed] as a part of 320 acres granted to Wm. Frels the said tract thus conveyed is the [ ] half of a certain tract of 220 acres sold by said Frels to Earl Bock containing one hundred and ten (110) acres sold by said Bock to John Schumaker by deed dated Decbr 24th 1852, all the above described tract and being the same land conveyed by Dillard Cooper to Y.A. Bayley by deed dated September 16th 1854 as per deed duly recorded in Colorado County Texas, in book letter "I" on pages 240 & 241 records for deeds of said County, and said land inherited by said Mary [T. or F.] Jenkins [was Mary [T. or F.] Bailey from said Y.A. Bayley - To have and to hold the above described premises, together with all and singular the rights and appurtenances thereto in anywise belonging unto the said A.G.G. Perkins his heirs or assigns forever, And we do hereby bind ourselves our heirs, executors and administrators, to warrant and forever defend all and singular the said premises unto the said A.G.G. Perkins his heirs and assigns, against every person whomsoever lawfully claiming or to claim the same or any part thereof Witness our hand this 9 day of Oct. 1886.
Know all men by these Presents that Catherine B. Mundine of the County and State aforesaid in consideration of one hundred and fifty four ($154 00/) dollars to me paid cash in hand and Ninety Seven Dollars and Sixty Six and two third ($97 66/100) and to be paid by the 25th of December AD 1874 by A.G.G. Perkins of the same County and State have granted bargained sold and released and by these presents to grant bargain sell and release unto the said A.G.G. Perkins a certain tract or parcel of land situated in the western portion of Burleson County on the P. Wimberly Survey, bounded as follows - to wit - Beginning at the N.W. corner of a Survey in the name of Reaves, Thence N 19 N 235 vas. To a Stake from which a Black Jack marked V then S 19 Degrees E 2 varas, Then N 70 degrees E 640 vrs to a rock from a port oak marked 1 vrs S 29 degrees W 7 v. Then S 70 e 280 v to a point in the middle of Woolly Branch, Thence down said Branch in a Southern direction to a point where the South boundary line of the Wimberly Survey crosses said Branch, Thence S 70 degrees W with said South boundary line 170 vrs to a S.E. Corner of the Reaves Survey, Thence S 19 degrees W 92 v. to an elm and corner of said Survey, Thence S 70 degrees North the north boundary line of said Survey 825 v. to the [place - crossed out] beginning corner containing thirty four (34) acres of land together with all and singular premises aforementioned unto the said AGG Perkins his heirs and assigns forever, and the said Catherine B. Mundine do hereby bind myself my heirs executors and administrators to warrant and forever defend the said premises unto the said A.G.G. Perkins his heirs and assigns against the claim or claims of every person whomsoever lawfully claiming or to claim the same or any part thereof. Witness my hand this March 12th day 1874.
On the 14th day of March A.D. 1874 before me appeared C.B. Mundine personally known to me to be the same person whose name is subscribed to the foregoing instrument Admitting authoring [ ] in the same and acknowledged the execution thereof as her own free act and deed for the uses and purposes therein expressed. This day personally appears and before me Eli Jones an acting Justice of the Peace in and for the County of Lee AGG Perkins and Silas Gilbert who being duly sworn deposith and saith on Oath that they praise a Gray mare and a suckling colt the said mare suppose to be about fifteen years old. We praised the said mare and colt in the possession of J. V. Smith at the true value, thirty dollars, Branded TN in the left shoulder, the above prossesment is correct to the best of our knowledge and belief on this the 14th day of August AD 1874.
Know all men by these Presents, that J.V. Smith as principal and AGG PERKINS and Silas as securities are held and firmly bound unto Jas. H. Fry District Clerk and his successors in Office in and for the County of Lee in the [penal] sum sixty dollars the payment of which will and truly to be made we hand ourselves our heirs, executors and administrators. Given under our hands this the 14th day of August AD 1874. The condition of the above obligation is such that if the above bounded J.V. Smith who has taken up advertise as the law directs a pong and a suckling colt the mare suppose to be about fifteen years old taken up on his premises, the mare branded thus TN on the left shoulder, if the said J.V. Smith shall have the gray mare and colt forthcoming on the 14th August 1875 in the town of Giddings exposed to sale to the highest bidder, pay the money to Jas. H. Fry, District clerk or his successors in Office after deducting the expense of ( ) said mare and colt if the proper owner does not prove the mare and colt away before the time passes then the above obligation to be null and void, otherwise to remain in full force and effect.
J.V. SmithKnow all men by these presents, that for and in consideration of the sum of Seventy Five 95/100 dollars to me in hand paid by W.M. Baker of the County and State aforesaid. And for the further consideration of other sums of many goods, mans and merchandise that may be advanced to me as supplies for my family. There this day sold unto the said Wm. M. Baker (3) Three Bales Cotton of the first picking now graining on my farm in Lee County. Said cotton to be delivered in the town of Giddings gined and baled, the price to be agreed upon when cotton is delivered. To have and to hold the sum unto the said Wm. M. Baker his heirs assigns and co. Witness my hand this 26th day of August 1878

Perkins to me personally known, and acknowledged that he executed the foregoing instrument of writing deed the 26th day of August A.D. 1878 and that he signed, sealed and delivered the same for the purposes, use and considerations therein stated. Know all men by these Presents that whereas, by virtue of a certain Order of Sale, issued out of the district court of the County of Lee in favor of William M. Joiner Administrator of Est. of Wm. Joiner vs. A.G.G. Perkins on certain Judgment and Decree of sale, rendered on the 15th day of May 1884 and directed an delivered to me as Sheriff of Lee County, commanding me to sell the premises described in said Order of sale, I, Wm. M. Brown, Sheriff, as aforesaid, did upon the 13th day of December 1884, advertise the said premises as described in said Order of sale by giving public notice of the time, place and terms of sale by causing an advertisement thereof to be posted up at three public places in the county aforesaid, one of which was the Court House Door of said county, for twenty days previous to said sale thereof and on the first Tuesday in January AD 1885 within the hours prescribed by law sold, said premises at public vendue in the County of Lee at the Court House Soon thereof, the Premises hereinafter described were struck off to J.L.Rousseau and John F. Crowe for the sum of Twenty six Dollars they being the highest bidder therefor and that being the highest bid for the same. Now therefor in consideration of the Premises aforesaid, and of the Payment of the said sum of twenty six Dollars, the receipt of which is hereby acknowledged, I, Wm. M. Brown, Sheriff as aforesaid have sold and by the Presents do grant and convey unto the said J.L. Rousseau and John F. Crowe all the estate right title and interest which the said A.G.G. Perkins had on the 15 day of December 1878 or at any time afterwards in and to the following named Premises as described in the Order of Sale, viz: A certain tract of land formerly situated in Burleson County but now in Lee county, Texas on the Waters of the 3rd [Hegua] being part of the C. Wimberly survey and bounded as follows: Beginning at the N.W. corner of a survey in the name of Reeves thence N. 19 W 235 vrs. To a stake from which a B.J. marked "V" vrs S 19 E 2 vs then N 71 E 640 vrs to a rock from which a P.O. marked J brs S 29 degrees W 7 vrs. - Thence S 70 E 280 vrs to a point in the middle of Woolley Branch thence down said Branch in a Southern direction to a point where the said south boundary line of the Wimberly survey crosses said branch then S 79 W with said S. boundary line 170 vrs to a S.E. corner of the Reaves survey, then N 19 W 92 vrs to an Elm and corner of said survey then N 71 E 140 vrs to a S.E. Know all men by these presents that I A.A.G. perkins and my wife J.P. Perkins have this day for an in consideration of the sum of One hundred ($100.00) Dollars to me in hand paid in two promissory notes 1st note for fifty dollars and signed by J.C. McDavid and made due on the 1st day of November 1886. The 2nd note for fifty dollars and signed J.C. McDavid with 10 percent interest from date and made due on the 1st day of November 1887, and bearing even date with this deed the receipt of which is hereby acknowledged did this day bargained, sold and conveyed unto the said J.C. McDavid of Lee county and State aforesaid all our right title and interest in and to a certain tract of land situated in Lee County and State aforesaid, and described as follows: Beginning at the SW corner of the Wimberly Survey Then N 19 degrees W 192 varas a stake from which a blackjack 10 in dia bears N 28 W 7 « varas when E 71 degrees E 82 varas a stake, a stake from which a port oak 20 in dia. Bears S 64 E varas thence E 19 degrees E 100 varas a stake from which a black jack 7 in in dia. Perkins wife of said A.G.G. Perkins [ ] examined by me privately and apart from her husband and having the same fully explained to her she the same Jennie P. Perkins acknowledged such instrument to me, to be her act and deed and she declared that she had willingly signed the same for the purposes and consideration therein expressed and that she did not wish to retract it.
